§ 8
CONSUMER RIGHT OF WITHDRAWAL FROM THE CONTRACT

Sales contracts concluded through the Online Store are distance contracts within the meaning of the Act of May 30, 2014 on consumer rights. Therefore, the Buyer who is a Consumer, in cases and under the conditions specified in the aforementioned Act, has the right to withdraw from the concluded sales contract within 14 days from the date of delivery of the goods, without providing any reason.

However, for goods made to the Consumer’s specifications or clearly personalized (Individual Orders), this right does not apply, as stated in Article 38 point 3 of the aforementioned Act.

Information about the right of withdrawal, including details on how and when to exercise this right and the costs of returning the goods in the event of withdrawal (which are borne by the Consumer), is provided in Appendix 1 to these Terms and Conditions. A statement of withdrawal from the contract may be combined with the physical return of the goods. To withdraw from the contract, the Consumer may use the withdrawal form, a template of which is provided in Appendix 2 to these Terms and Conditions. In the event of withdrawal, the cost of returning the goods is borne by the Buyer.

If the contract is withdrawn from, LadyBuq is obliged to refund the Buyer an amount equal to the purchase price of the returned goods and the cost of delivery, with the reservation that if the Consumer chose a delivery method other than the least expensive standard delivery method offered by LadyBuq, LadyBuq is not required to reimburse the Consumer for any additional costs incurred.

If the contract is withdrawn from, LadyBuq will promptly, no later than 14 days from the date of receiving the Consumer’s withdrawal statement, refund all payments received from the Consumer, including the cost of delivery of the goods, except for additional costs resulting from the delivery method chosen by the Consumer other than the least expensive standard delivery method offered by LadyBuq.

If the contract is withdrawn from by a Customer purchasing from outside the European Union, LadyBuq will only refund the amount paid for the returned goods.

The refund will be made by LadyBuq using the same payment method used by the Consumer, unless the Consumer has expressly agreed to a different method of refund-in any case, the Consumer will not incur any fees related to this refund.

In the event of withdrawal, the Consumer is obliged to return the goods promptly, no later than 14 days from the day they informed LadyBuq of their withdrawal from the contract. To meet the deadline, it is sufficient to send the goods before the 14-day period expires to the following address:
“LadyBuq” Art. Studio Dariusz Bełch, Kraczkowa 1079a, 37-124 Kraczkowa, Poland, with the note “Return”.

The goods should be returned to the above address in a rigid box, e.g., the one in which the goods were delivered to the Consumer. The returned goods must be sent in an undamaged condition, with tags and proof of purchase (receipt). LadyBuq requires that returned goods be properly packaged so that they are not creased, damaged, etc. during transport.

LadyBuq may withhold the refund until it has received the goods back or the Consumer has provided proof of having sent back the goods, whichever occurs first.

The Consumer is responsible for any diminished value of the goods resulting from handling them in a way other than what is necessary to establish the nature, characteristics, and functioning of the goods.

§ 9
GENERAL INFORMATION REGARDING PRODUCT COMPLAINTS

If, in the Customer’s opinion, the purchased goods are defective, regardless of other rights, the Customer may request the repair or replacement of the goods with new ones. For this purpose, the Customer should:

return the goods (if possible, in the original packaging and with proof of purchase) to the following address:
“LadyBuq” Art. Studio Dariusz Bełch, Kraczkowa 1079a, 37-124 Kraczkowa, Poland, with the note “Complaint”;

send or otherwise submit to the above address a written statement containing a complaint about the defective goods; the Customer may use the complaint form, a template of which is provided in Appendix 3 to these Terms and Conditions;

indicate in the statement whether they are requesting the repair of the goods or replacement with new, defect-free goods, describe the defect and the date it occurred;

provide contact details for handling the complaint, including mailing address, email address, and phone number.

LadyBuq will review the complaint within 14 days from the date it is submitted by the Customer.

If the complaint is resolved in favor of the Customer, LadyBuq will, according to the Customer’s request, repair the goods or replace the defective goods with a new, defect-free item. LadyBuq may refuse the Customer’s request for repair if it is impossible or, compared to the alternative (i.e., replacement with a new, defect-free item), would involve excessive costs.

LadyBuq covers justified complaint costs, including the documented cost of returning the goods subject to complaint by the Customer.

Color transfer or discoloration is not considered a valid complaint, as the products are made from natural leather. LadyBuq informs that only natural leather is used, which, as a natural product, may have differences in texture, shade, thickness, marks, scars, or wrinkles. These differences should not be treated as defects. They are characteristic features of the natural material-leather.

LadyBuq informs that any discrepancies regarding the size of the handbag should be consulted with LadyBuq, as for handbags with irregular shapes, the dimensions provided by LadyBuq on the Online Store website and those measured by the Customer (measured independently) may differ. This may result from the Customer measuring the handbag in a different place than LadyBuq did.

Differences resulting from the individual settings of the Consumer’s computer (color, proportions, etc.) cannot be the basis for a complaint about the goods.

LadyBuq is obliged to deliver goods to Customers free from physical and legal defects. LadyBuq is liable to Customers for defects in the goods under the terms specified in the Polish Civil Code of April 23, 1964 (consolidated text: Journal of Laws of 2014, item 121, as amended).
